What is the Stormwater Utility Used For?
What Does The Stormwater Utility Fee Fund:

Ordinance 07-18 was approved by the Board of County Commissioners on August 21, 2007. However, according to County Attorney's Office File: CAO 07-2826, the process of establishing the Stormwater Management System Utility goes back to 2006. Section 1 of SECTION B of Stormwater Management System Utility Ordinance No.07-18 provides the legal authority for the establishment of the County's Stormwater Utility Fee. Section 12 of the Ordinance establishes a Utility fund for the deposit of all fees and charges collected by the Utility. The funds are for the exclusive use of the Utility, including but not limited to the following:

  • Administrative costs associated wlth the management of the Utility.
  • Planning and Engineering.
  • Operation and Maintenance of the Stormwater Management System.
  • Funding of pollution abatement devices constructed on stormwater systems discharging to the surface waters of Pasco County.
  • Debt Service financing.
  • Extension and Replacement costs.
  • Construction of flood control and water quality projects.

The Stormwater utility also provides funding necessary to meet certain legal obligations of state and federal law regarding the water quality of stormwater, such as the County's National Pollutant Discharge Elimination Systems (NPDES) Permit Compliance Program. The NPDES Permit is a federally mandated program that is authorized by the 1972 Clean Water Act of the United States Congress.The NPDES program is not delegated to the Florida Department of Environmental Protection. As noted above, the Utility covers constructing improvements and extensions to the existing drainage systems to ensure that the collection and disposal of stormwater within Pasco County adequately protects the health, safety and welfare of the citizens of Pasco County.
