What Is the Storwater Utility Fee?
The user is referred to the document entitled: Stormwater Management System Utility Ordinance 07-18 by clicking this link or the links below, to review the actual Ordinance and history of the County's Stormwater Utility Fee.  Pasco County developed a Stormwater Utility Update Report in 2006. The Report indicated that the drainage system at that time was inadequate to control and manage stormwater runoff within Pasco County. The Report additionally concluded that it will be necessary and essential to construct improvements and extensions to the existing drainage system to ensure that the collection and disposal of stormwater within Pasco County adequately protects the health, safety, and welfare of the citizens of Pasco County.

After a June 5, 2007 staff presentation the BCC recommended a preferred funding level of $47.00 per Equivalent Residential Unit (ERU), per year, and directed the Engineering Services Department in conjunction with the County Attorney's Office, to prepare an ordinance creating a Stormwater Management System Utility for introduction to the BCC. The Ordinance defines an "ERU" as the median Impervious Area of Residential Developed Property per Dwelling Unit located within Pasco County and as established by Board resolution, as provided in the Ordinance and as may be amended from time to time. The term excludes Department of Revenues Land Codes 00 and 04 as defined by Subsection 8.008(2)(c), Florida Administrative Code.

After public hearings, Pasco County Ordinance No. 07-18 was finally approved by the Board of County Commissioners on August 21,2007 and officially entitled:

"AN ORDINANCE OF PASCO COUNTY, FLORIDA, PROVIDING FOR A STORMWATER  MANAGEMENT SYSTEM UTILITY, SPECIFYING TERMS AND PROCEDURES FOR THE UTILITY; IMPOSING UTILITY FEES AND RATE SCHEDULE; PROVIDING FOR FEE EXEMPTIONS AND CREDITS; PROVIDING PROVIDING FEE BILLING, PAYMENT AND
PENALTIES; FOR A STORMWATER UTILITY FUND; PROVIDING FOR MODIFICATION THAT MAY ARISE FROM CONSIDERATION AT PUBLIC HEARING; PROVIDING FOR SEVERABILITY, REPEALER, CONFLICT, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE."

As stated in the official title and documented in Section 12 of that Ordinance, a Stormwater Utility Fund was also established.  The funds are for the exclusive use of the Utility including but not limited to:
  • Administrative costs associated with the management of the Utility.
  • Planning and Engineering.
  • Operation and Maintenance of the Stormwater Management System.
  • Funding of pollution abatement devices constructed on stormwater systems discharging to the surface waters of Pasco County.
  • Debt Service financing.
  • Extension and Replacement costs.
  • Construction of flood control and water quality projects.

On Septmeber 2, 2015, the BCC approved a $10.00 increase in the Stormwater Utility Fee to a new amount of $57.00 per ERU, per year.
