A RESOLUTION FOR WILLIAMSBURG SUBDIVISION PROJECT NO. 707 PROPOSING TO PAVE AND IMPROVE CERTAIN RIGHTS-OF-WAY BY ASSESSSING THE OWNERS OF LANDS INVOLVED IN THE BENEFITED AREA; PROVIDING FOR A UNIT BASIS UPON WHICH ASSESSMENTS SHALL BE DETERMINED; PROVIDING AN ESTIMATED COST OF THE IMPROVEMENTS; PROVIDING A METHOD OF PAYMENT OF ASSESSMENTS; PROVIDING AN EFFECTIVE DATE

WHEREAS, pursuant to the provisions of Pasco County Ordinance No. 02-17, Article 1, Section 94-8, a preliminary assessment roll for the proposed Williamsburg Subdivision Paving Assessment project is on file and open to the public for inspection in the Paving Assessment Department at the West Pasco Government Center, 7530 Little Road, Suite 230, New Port Richey, Florida; and
WHEREAS, the Engineering Services Department has scheduled a public hearing before the Board of County Commissioners on December 10, 2002, at 9:30 a.m., at the Historical Pasco County Courthouse, Board Room, 37918 Meridian Avenue, Dade City, Pasco County, Florida; and
WHEREAS, this is a combined public hearing in accordance with Pasco County Ordinance No. 02-17, Article 1, Section 94-9, which provides for a single, combined public hearing in those instances in which quantities and unit cost required to complete the proposed project are known; and
WHEREAS, as provided in Pasco County Resolution No. 02-210, the amount of each special assessment for improvements shall be based on the respective lands benefited thereby in accordance with the per lot unit basis method of determining the extent to which lands are specifically benefited by said improvement; and
WHEREAS, the resurfacing project will provide a particular and special benefit to those property owners listed on the assessment roll, which benefits include, but are not limited to, an increased use and enjoyment of the property; potentially increased property values; improved public health, safety, and welfare considerations; and better access for public safety and service vehicles; and
WHEREAS, sixty-four percent (64%) of the property owners that have responded to said petition are in favor of the Williamsburg Subdivision Paving Assessment project and are requesting that the Board of County Commissioners grant their approval to pave and improve certain road rights-of-way in the specially benefited area described below.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pasco County, Florida, in regular session duly assembled that:
Section 1. Pursuant to the provisions of Pasco County Ordinance No. 02-17, Article 1, Section 94-15, the Board of County Commissioners hereby proposes to pave and improve the following rights-of-way:

by assessing the owners of property with the following parcel identification numbers: Section 31, Township 26 South, Range 20 East, Sub 0010, Block 00000, Lots 2200-2330 inclusive. Sub 0020, Block 00000, Lot 00C0. Lots 0010-2190 inclusive. There are 241.3 equivalent residential units included in this project.
Section 2. The maximum total cost for the Williamsburg Subdivision Paving Assessment project is Three Hundred Thousand, Eight Dollars and 29/100 ($300,008.29), or One Thousand, Two Hundred Forty-Three Dollars and 30/100 ($1,243.30) per equivalent residential unit. The maximum project cost includes resurfacing of the listed streets only and no costs have been included for drainage alterations. It should be noted that the maximum total cost for the entire project includes asphalt work to be performed pursuant to Pasco County’s Annual Asphalt Contract in a maximum amount of $200,000.00, together with additional work to be performed by the County’s own services, employees, and equipment in a maximum amount of $100,008.29 for said additional work.
Section 3. The assessments to be levied against the properties shall become due and payable to the Board of County Commissioners thirty-three (33) days after the date of initial billing, said billing to be issued only after substantial completion of the paving assessment project. All special assessments not paid within said period shall become payable in annual installments in each of the five (5) succeeding years with interest of 7.00 percent (7.00%) per annum from the expiration of said thirty-three (33) days; provided that any special assessment becoming so payable in installments may be paid at any time together with interest accrued thereon to the date of payment.
Section 4. When final completion has been achieved on the project and the Board of County Commissioners has approved and directed the recording of a final assessment roll, the final assessment roll shall constitute a lien on each property assessed for any improvements or services under the provisions of Pasco County Ordinance No. 02-17.
Section 5. This resolution shall take effect immediately upon its adoption.
