It is recommended that the data herein presented be given formal consideration by the Board of County Commissioners.

 

DESCRIPTION AND CONDITIONS:

 

The property owners within Williamsburg Subdivision (15 streets), submitted a petition requesting road paving at a maximum assessment of $1,243.30 per equivalent residential unit. Of the 241.3 equivalent residential units, 166.3 or 69 percent (69%) responded to the petition.  Of the 166.3 responses received, 106 or 64 percent (64%) have signed a petition in favor of the assessment.  The paving will provide a particular and special benefit to property owners.  These benefits include, but are not limited to, an increased use and enjoyment of the property; potentially increased property values; improved public health, safety, and welfare considerations; and better access for public safety and service vehicles.  It is requested that the Board consider the special benefits received in determining whether the property owners should be specially assessed for the roadway reconstruction and paving.  All the requirements in Ordinance No. 02-17 have been met to date, including a notice published on November 21, 2002, in the Tampa Tribune, Pasco Edition, and notification by certified mail to all property owners listed on the roll. When final completion of construction has been achieved and the Board has approved and directed the recording of a final assessment roll, the final assessment roll shall constitute a lien on each property under the provisions of Ordinance No. 02-17.

 

The Williamsburg Subdivision Paving Assessment project is located in Section 31, Township 26 South, Range 20 East, and is approximately 0.8 miles north of the intersection of County Line Road and Bruce B. Downs Blvd. (CR-581).

 

The Engineering Services Department proposes to mill along existing curb and gutter areas, level where necessary, resurface within existing length and width with 2 inches of Hot Mix Asphalt, and install necessary signs and markings. There are no drainage alterations included in this project.

 

All roads in Williamsburg Subdivision are County maintained roads, approximately 25 years old, and have a current pavement rating of “D” on the Pasco County Infrastructure Management Road Master priority list. Right-of-way is by Plat.

 

A project cost estimate, based upon site inspection, proposed improvements, and the Annual Asphalt Contract, totals a maximum of $300,008.29, or $1,243.30 per equivalent residential unit. Based on the current “D” pavement rating, and the maximum assessment of $1,243.30 per equivalent residential unit, this project would qualify for an assessment reduction under the approved policy guidelines.

 

This is a single public hearing in accordance with Article 1, Section 94-9, of Ordinance No. 02-17.

 

If the Board determines to make the improvements under Special Assessment Ordinance No. 02-17, a resolution must be adopted which includes the unit the assessments are to be based upon, the rate of interest, and the number of annual installments. 

 

In accordance with the provisions of Section 255.20, Florida Statutes when the total maximum construction cost for a project exceeds Two Hundred Thousand Dollars ($200,000.00), the Board must competitively award this project to an appropriately licensed contractor unless the Board, after proper notice, finds that it is in public’s best interest to perform the project using the County’s own services, employees, and equipment together with the County’s Annual Asphalt Contract.  The proposed resolution includes a specific determination by the Board that it is in the public’s best interest that a portion of the streets in the Williamsburg Subdivision Paving Assessment project be performed by using the County’s own services, employees, and equipment in conjunction with the Annual Asphalt Contract.

 

Williamsburg Subdivision was petitioned per the equivalent residential unit methodology.  233 property owners were assessed one (1) equivalent residential unit each. The property listed on the property appraiser’s file as Williamsburg/Tampa Bay, known as the Williamsburg Tampa Bay Management Corporation’s Clubhouse, Parcel No. 31-26-20-0020-00000-00C0, was included and assessed for 8.3 equivalent residential units. At the time the project was petitioned, the Paving Assessment office was unaware that property owners in Williamsburg Subdivision were not required to become members or pay membership fees to the clubhouse. By assessing the clubhouse, the burden of the assessment will not be distributed among all of the property owners in the subdivision. The President of the Williamsburg Tampa Bay Management Corporation Clubhouse has questioned whether this was a fair assessment. After discussing this issue with staff, the Engineering Services Department is requesting the Board’s approval to remove the assessment of 8.3 equivalent residential units from Williamsburg/Tampa Bay (the clubhouse), Parcel No. 31-26-20-0020-00000-00C0, from the paving assessment project. This will reduce the assessment roll by 8.3 equivalent residential units at $1,243.30 each, for a total reduction of $10,319.39. This deletion of 8.3 equivalent residential units and the cost reduction will not affect the property owners’ assessment cost of $1,243.30 per equivalent residential unit.

 

ALTERNATIVES AND ANALYSIS:

 

Based upon the information provided, some of the alternatives available to the Board in this matter are: 

 

1.                  Accept the petition and authorize the Engineering Services Department to proceed with the paving of Williamsburg Subdivision; approve the attached assessment roll, and adopt the attached resolution setting a maximum assessment of $1,243.30 per equivalent residential unit for annual installments over a five-year period with 7.00 percent (7.00%) interest on the unpaid balance. This alternative will remove 8.3 equivalent residential units from the overall assessment project for Parcel No. 31-26-20-0020-00000-00C0, creating a reduction of $10,319.39 to the Paving Assessment Receivable; which will be accounted for at the set assessment after construction.    

 

2.             Accept the petition and authorize the Engineering Services Department to proceed with the paving of Williamsburg Subdivision; approve the attached assessment roll, and adopt the attached resolution setting a maximum assessment of $1,243.30 per equivalent residential unit for annual installments over a five-year period with 7.00 percent (7.00%) interest on the unpaid balance.  This alternative will not remove 8.3 equivalent residential units from the overall assessment project for Parcel No. 31-26-20-0020-00000-00C0.

 

RECOMMENDATION AND FUNDING:

 

The Engineering Services Department recommends that the Board approve Alternative No. 1, authorize the Chairman’s signature on the attached resolution, and direct Secretarial Services to distribute as follows: one copy of the executed resolution to Engineering Services Department, Design/Stormwater Management Division, New Port Richey; and one copy of the executed resolution to Development Services Administration, New Port Richey.
