DESCRIPTION AND CONDITIONS:

 

Pursuant to Chapter 125.02(k), Florida Statutes, Pasco County is authorized to provide and regulate water, waste, and sewage collection and disposal.  Accordingly, Pasco County has adopted Ordinance No. 87-09, together with subsequent amendments, currently codified in the Pasco County Code as Chapter 110.  Section 110-31 and Section 110-119 of the Pasco County Code establish a procedure to obtain domestic water and sewer service from the County's utility facilities via application to the County and submission of required deposits, including a service commitment fee.  The service commitment fee is a nonrefundable payment equal to 100 percent of the impact fee in existence for the development or project at the time the County issues its service commitment.

 

The procedure established by Section 110-31 and Section 110-119 of the Pasco County Code provides a more reasonable payment schedule for those entities seeking to obtain domestic water and sewer service from the County.  The service commitment fee payment plan, which is known as the "10-40-50" plan, expired under the current Code on October 1, 2002.  In order to continue the service commitment fee payment schedule (the "10-40-50" plan), an ordinance must be enacted which provides for an extension of the effective period of the pertinent sections of Chapter 110 of the Pasco County Code.  The proposed ordinance amending Chapter 110 of the Pasco County Code would provide for the extension of the effective period of the service commitment fee payment plan (the "10-40-50" plan) and retroactively establish another extension from October 1, 2002, until September 30, 2005.

 

ALTERNATIVES AND ANALYSIS:

 

The Board is requested to consider the following alternatives:

 

1.                  Approve the proposed ordinance amending Chapter 110 of the Pasco County Code regarding service commitment fees and instruct staff to schedule a public hearing.

 

2.                  Do not approve the proposed ordinance amending Chapter 110 of the Pasco County Code, which would cause the expiration of service commitment fee payment plan (the "10-40-50" plan).

 

RECOMMENDATION AND FUNDING:

 

The Utilities Services Branch recommends that the Board approve the attached proposed ordinance amending Chapter 110 of the Pasco County Code regarding utilities, waive the normal review process by the Citizens Ordinance Review Committee because this is only a time extension of the existing Ordinance, and authorize staff to advertise for a public hearing to adopt the attached proposed ordinance amendments.

 

No funding is required for this item.
