LOCATION AND DESCRIPTION: The property is located on a northeast path from Little Road to S.R. 54 (Sections 31 and 32, Township 26 South, Range 17 East).
APPLICATION: Administrative Appeal
ZONING DISTRICT: MPUD Master Planned Unit Development
LAND USE CLASSIFICATIONS: RES-3 (Residential - 3 du/ga), RES-9 (Residential - 9 du/ga), ROR (Retail/Office/Residential), and IL (Industrial - Light)
EXPLANATION OF APPEAL: The applicant contends that the Development Review Committee (DRC) erred in determining that the applicant was required to install streetlights along a specified portion of the Trinity Boulevard Extension.
FINDINGS OF FACT:
1. The construction plans have been reviewed by the Growth Management Department for compliance with the Pasco County Land Development Regulations; Section 500, Zoning, and the Comprehensive Plan; and was found to be consistent with Section 500, Zoning, and the Comprehensive Plan.
2. The construction plans for the above-subject project was prepared for Adam Smith Enterprises, Inc., by Coastal Design Consultants. The plan was originally received by the Development Review Division (DRD) on October 29, 2001.
3. The roadway has been designated as a public roadway.
4. The plans have been certified by the design engineer to be in substantial conformance with the "Uniform Minimum Standards for Design, Construction, and Maintenance of Streets and Highways" as required by Section 336.045, Florida Statutes.
5. On May 21, 2002, DRD approved the construction plans for the referenced project with conditions.
6. On July 11, 2002, DRC upheld staff recommendations to deny the applicant's request to delete Condition No. 8 of the construction approval.
ALTERNATIVES AND ANALYSIS:
Based upon the above and/or documentation on file, some of the alternatives available to the Board of County Commissioners are:
1. Deny the applicant's request and uphold the July 11, 2002, DRC decision.
2. Reverse DRC's decision of July 11, 2002.
3. Take alternative actions as the Board determines.
RECOMMENDATION:
The Development Review Services Department recommends that the Board approve Alternative No. 1.
