It is recommended that the data herein presented be given formal consideration by the Board of County Commissioners.
DESCRIPTION AND CONDITIONS:
Pursuant to Subsection 380.06(19), the local government shall establish a public hearing to consider the change that the developer asserts does not create a substantial deviation.
On December 12, 1989, the Board approved a development order (DO) for Wesley Chapel Lakes Development of Regional Impact (DRI) No. 166 (Resolution No. 90-55). DO provided for a four-phase project consisting of 393,200 square feet of office, 1,161,800 square feet of commercial, and 4,520 dwelling units, with a build-out date of December 19, 2009.
On May 14, 1991, the Board approved an amendment to DO (Resolution No. 91-252) extending the performance dates for the project's pipeline project by one year.
On April 13, 1993, the Board approved an amendment to DO (Resolution No. 93-92) extending the pipeline performance dates, commencement date, Phase I-IV build-out dates, duration date, and time during which the development will not be subject to downzoning, unit density reduction, or intensity reduction by five years, 11 months, and 15 days for a cumulative total six years, 11 months, and 15 days.
On November 16, 1999, the Board approved an amendment to DO (Resolution No. 00-37) extending the pipeline improvement design, commencement, and completion date by three years for a cumulative total of 9 years, 11 months, and 15 days, and identified additional or alternative pipeline improvements.

1 Specific approval has only been granted for Phase I. Subsequent approval of later phases shall be contingent upon further Chapter 380.06 analysis.
2 Condition D.16.f requires that, at minimum, 70 percent of the residential units shall be "deed restricted" and designed to serve the elderly population.
Presently, the developer of Wesley Chapel Lakes wishes to make the following modifications to DO and master plan:
1. Amend Master Development Plan Map H to add 118.2 acres of land to the southwest corner and the south boundary of the project, without increasing development entitlements and to reconfigure various development parcels.
2. Amend the DO duration date by a cumulative total of 21 years and 12 days, from December 19, 2009, to December 31, 2030.
3. Amend the timing and entitlements within each project phase as represented by the proposed phasing schedule, as follows:

1 The project will retain conceptual approval only for Phases II-IV.
2 At a minimum, 1,000 of the residential units shall be established for the elderly as defined by Section 760.29, Florida Statutes.
4. Update the Phase I proportionate share.
5. Replace the previously approved pipeline projects with the construction of the extension of S.R. 56 from C.R. 581 eastward through the project.
6. Amend the schedule for completion of the pipeline improvement.
7. Reduce the elderly housing component of the project from 3,164 to 1,000 units.
8. Amendments to the housing section conversion formula for retirement units.
9. Amend the Chancey Road and S.R. 54 right-of-way dedication.
In addition to the requested changes, staff is recommending additional amendments to DO, including the following:
1. Amendments to the transportation section, including a provision for a development agreement for the pipeline project, alternative pipeline project, other site-related improvements, impact fees, monitoring, access management, and the default provision.
2. Amendments to the recreation section for consistency with the existing MPUD Master Planned Unit Development zoning.
3. Adding a provision recognizing the adoption of a development agreement.
ALTERNATIVES AND ANALYSIS:
1. Approve the proposed changes and approve and authorize the Chairman to execute the attached resolution and Notice of Adoption.
2. Approve the proposed changes with additional modifications or conditions.
3. Deny the proposed changes.
4. Recommend further Development of Regional Impact (DRI) review.
5. Direct staff as to other action desired by the Board.
RECOMMENDATION AND FUNDING:
The Growth Management Department staff recommends that the Board approve Alternative No. 1 above and that:
1. The Board determines that the development does not require further DRI review.
2. DO shall be amended as indicated in the attached resolution.
3. The remaining conditions of DRI/DO for Resolution No. 90-55, as subsequently amended, shall remain in full force and effect.
It is further recommended that the Board direct Secretarial Services to return five certified copies of the Resolution and Notice of Adoption to the Growth Management Department, New Port Richey. The Growth Management Department will then send the requested copies to the appropriate parties.
