LOCATION AND DESCRIPTION: The property is located on the south side of Crescent Lake Drive at C.R. 581 (Section 36, Township 26 South, Range 19 East).

LAND USE CLASSIFICATION: RES-6 (Residential - 6 du/ga)
EXPLANATION OF APPEAL: Mr. Albert E. Ford II, attorney for Peregrine International, LLC, is appealing the August 8, 2002, decision by the Development Review Committee (DRC) to deny his client's request for a variance from Section 9.B of the Landscaping and Irrigation Ordinance which would have allowed the utilization of an existing 10-foot landscape area along C.R. 581 versus the installation of the required 20-foot buffering with berm and plantings.
FINDINGS OF FACT:
1. On May 27, 1999, DRC approved the preliminary site plan for Northwood Center South.
2. On January 18, 2001, DRC approved the construction plans for Northwood Center South.
3. On February 26, 2002, the Board of County Commissioners adopted Pasco County Landscaping and Irrigation Ordinance No. 02-04 which replaced previous landscaping requirements.
4. On July 2, 2002, an application for a variance from Section 9.B of Landscaping and Irrigation Ordinance No. 02-04 was submitted for Out-Parcel "C" of the Northwood Center South by Peregrine International, LLC. The proposed project, for which site plans have not been submitted, was to include a gas station-convenience store and an automobile-repair facility. Landscaping requirements fall under Section 9, Automotive Service Stations and Convenience Stores with Gas Pumps, of the Landscaping and Irrigation Ordinance.
5. On August 8, 2002, DRC denied the variance petition request.
6. On August 30, 2002, Mr. Ford, attorney, filed this application for an appeal of DRC's decision.
ALTERNATIVES AND ANALYSIS:
Based upon the above and/or documentation on file, some of the alternatives available to the Board are:
1. Deny the applicant's appeal request and uphold the August 8, 2002, DRC decision.
2. Reverse DRC's decision of August 8, 2002.
3. Take alternative actions as the Board determines.
RECOMMENDATION:
The Development Review Services Department recommends that the Board approve Alternative No. 1.
