This is in response to the petition of Alvin Chin, who has requested a public hearing before the Board of County Commissioner’s regular meeting of September 24, 2002.

 

It is recommended that the data herein presented be given formal consideration by the Board.

 

DESCRIPTION AND CONDITIONS:                                                                             

 

The petitioner seeks to vacate the following portion of easement:

 

SEE EXHIBIT “A” ATTACHED HERETO AND

BY REFERENCE MADE A PART HEREOF

 

The petitioner requests this vacation of a portion of easement for the following reason: Concrete pool decking and screening enclosure encroach into the easement.

 

The subject property is located on the southwest corner of Embassy Boulevard and Greenbriar Lane.

 

Said portion of easement has been dedicated to the public by Plat Book 16, Pages 7, 8, and 9, Regency Park Unit Twelve, Lot 1860, as recorded in the Public Records of Pasco County, Florida.

 

The Pasco County Real Estate Division has found one objection to the petition to vacate the above-described portion of easement.  Pasco County Utilities has requested a License Grant from the petitioner.  The petitioner has complied with this request and the executed License Grant accompanies the petition.

 

ALTERNATIVES AND ANALYSIS:

 

After reviewing the petition and inspecting the property, the Board has two alternatives:

 

1.         To approve the petition as requested.

 

2.         To disapprove the petition should there be some future need for this portion of easement.

 

RECOMMENDATION AND FUNDING:

 

Therefore, the Real Estate Division recommends the Board approve Alternative No. 1, and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the portion of easement, and the attached executed License Grant; and further instruct the

 

Clerk of the Circuit Court to record the attached executed License Grant of Lot 1860, Regency Park Unit Twelve.

 

No funding will be required to complete this project.
