RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF PASCO COUNTY, FLORIDA, DESIGNATING THAT AREA COMMONLY REFERRED TO AS "OTIS MOODY" AS A SERVICE AREA FOR THE PURPOSE OF STREET LIGHTING IMPROVEMENTS AND AUTHORIZING THE INSTALLATION OF STREETLIGHTS WITHIN THE SERVICE AREA AND THE LEVY OF ASSESSMENTS AGAINST THE PROPERTY BENEFITED BY THE INSTALLATION OF STREET LIGHTING IMPROVEMENTS IN ACCORDANCE WITH THE PASCO COUNTY CODE OF ORDINANCES, CHAPTER 94, ARTICLE II, SECTIONS 94‑46 THROUGH 94‑56
WHEREAS, pursuant to the Pasco County Code of Ordinances, Chapter 94, Article II, Sections 94‑46 through 94‑56, the Board of County Commissioners of Pasco County, Florida, is authorized to establish street lighting service areas for the purpose of providing lighting services to the citizens in the unincorporated areas of the County; and,
WHEREAS, after due public notice, the Board has held a public hearing on the advisability of providing street lighting services to that area known as "Otis Moody" and more specifically described in Exhibit A, attached hereto and incorporated herein by reference; and,
WHEREAS, the Pasco County Utilities Services Branch has received a lighting diagram from the appropriate power company and has determined the monthly assessment rate for each lot within the proposed service area; and,
WHEREAS, the Board finds that it is in the public interest to provide street lighting services to the property described in Exhibit A and to defray the cost of such services by levying and collecting special assessments against the property benefited; and,
WHEREAS, the streetlight assessments are based upon the pro rata share of each property parcel benefited by the "Street Lighting Service Area"; and,
WHEREAS, the improvements to be installed pursuant to the terms of this resolution and the Pasco County Code of Ordinances, Chapter 94, Article II, Sections 94‑46 through 94‑56, are for the purpose of lighting those streets and roads identified in Exhibit B attached hereto and incorporated herein by reference, which fall within the designated service area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pasco County, Florida, in regular session duly assembled that, pursuant to the provisions of the Pasco County Code of Ordinances, Chapter 94, Article II, Sections 94‑46 through 94‑56, the area commonly known as "Otis Moody" and as more particularly described in Exhibit A is hereby designated a service area for street lighting improvements, and the Pasco County Utilities Services Branch is authorized to request the appropriate power company to install the said street lighting improvements in accordance with the previously submitted lighting diagram.
BE IT FURTHER RESOLVED that yearly special assessments for the lighting improvements provided herein in the amount of Thirty-Eight and 00/100 Dollars ($38.00), or in the amount subsequently established by a resolution adopted pursuant to the Pasco County Code of Ordinances, Chapter 94, Article II, Sections 94‑46 through 94‑56, shall be levied against each lot within the service area and collection of such assessments shall be in accordance with the provisions of the Pasco County Code of Ordinances, Chapter 94, Article II, Sections 94‑46 through 94‑56.
