RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF PASCO COUNTY, FLORIDA, ESTABLISHING ANNUAL DISPOSAL ASSESSMENTS, TIPPING FEES, AND OTHER RATES, FEES, AND CHARGES FOR FUNDING THE SOLID WASTE DISPOSAL AND RESOURCE RECOVERY SYSTEM PURSUANT TO THE PASCO COUNTY CODE OF ORDINANCES, CHAPTER 90, ARTICLE III; AUTHORIZING PREPARATION OF ANNUAL DISPOSAL ASSESSMENT ROLL AND PREPARATION OF APPROPRIATE BILLS.

WHEREAS, on or before the fifteenth of September of each year, the Board of County Commissioners is required to adopt a Rate and Use Classification Resolution incorporating a determination of solid waste generation rates, annual rates, fees, charges, assessment or service charges to be imposed upon the owners of improved real property, and a schedule of tipping fees to be charged by the County for receiving and disposing of solid waste not generated within the County or for those properties not subject to assessments and for receiving and disposing of special waste; and,

WHEREAS, the Board of County Commissioners has hereto provided notice of the public hearings to be held on September 4, 2002, for the purpose of adopting said resolution in accordance with the requirements of the Pasco County Code of Ordinances, Chapter 90, Article III.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pasco County, Florida, in regular session duly assembled, that said Board hereby determines as follows:

1.         That those rates and use classifications set forth in Exhibit A are hereby adopted as the annual disposal assessments for improved real property within the County to be levied and assessed upon said improved real property due and payable on or before March 31, 2003, in order to fund the construction, operation, and the expenses of the County's Solid Waste Disposal and Resource Recovery System for Fiscal Year 2002-03.

2.         That those tipping fees set forth in Exhibit B are the tipping fees to be charged by the County for receiving and disposing of solid waste not generated within the County and for receiving and disposing of solid waste generated from property not subject to assessments.

3.         That those tipping fees set forth in Exhibit C are the tipping fees to be charged by the County for disposing of special waste in the County's Solid Waste Disposal and Resource Recovery System.

4.         That the final date for filing annual appeals or returns for solid waste assessment notices or bills relative to the attached rates, fees, and charges shall be January 31, 2003.

5.         That the Pasco County Utilities Services Branch is hereby directed to prepare the appropriate assessment roll of the Annual Disposal Assessments for certification of improved residential property assessments to the Tax Collector for collection and to prepare the appropriate bills for owners of improved nonresidential property for collection in accordance with Pasco County's Code of Ordinances, Chapter 90, Article III.
