This is in response to the petition of Jeffrey P. Cadwell and Constance A. Cadwell, who have requested a public hearing before the Board of County Commissioner’s regular meeting of August 27, 2002.

 

It is recommended that the data herein presented be given formal consideration by the Board.

 

DESCRIPTION AND CONDITIONS:                    

 

The petitioners seek to vacate the following rights-of-way:

The petitioners request this vacation of rights-of-way for the following reason:

 

The right-of-ways to be vacated were originally platted in 1911, created by the Tampa-Tarpon Springs Land Company.  The portions lying outside of U.S. Highway 19 are no longer used for road rights-of way purposes. 

 

The subject property is located on the west side of U.S. Highway 19, north and south of Westwood Drive.

 

Said rights-of-way have been dedicated to the public by the recorded plat of Tampa-Tarpon Springs Land Company Subdivision, portion of Tracts 40, 45, 46, 52, 57, and 60, as recorded in Plat Book 1, Pages 68, 69, and 70, of the Public Records of Pasco County, Florida.

 

ALTERNATIVES AND ANALYSIS:

 

After reviewing the petition and inspecting the property, the Board has two alternatives:

 

1.        To approve the petition as requested.

 

2.        To disapprove the petition should there be some future need for these rights-of-way.

 

RECOMMENDATION AND FUNDING:

 

Therefore, the Real Estate Division recommends the Board approve Alternative No. 1 and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described rights-of-way of Tampa-Tarpon Springs Land Company Subdivision, portion of Tracts 40, 45, 46, 52, 57 and 60.

 

 

No funding will be required to complete this project.
