It is recommended that the data herein presented be given formal consideration by the Board of County Commissioners.
DESCRIPTION AND CONDITIONS:
The property owners in Viva Villas have submitted a petition requesting road paving, at a maximum assessment of $878.33 per lot. Of the 224 property owners (230 lots), 157 or 70 percent (70%) responded to the petition. Of the 157 responses received, 91 or 58 percent (58%) have signed a petition in favor of the assessment. The paving will provide a particular and special benefit to property owners. These benefits include, but are not limited to, an increased use and enjoyment of the property; potentially increased property values; improved public health, safety, and welfare considerations; and better access for public safety and service vehicles. It is requested that the Board consider the special benefits received in determining whether the property owners should be specially assessed for the roadway paving. All the requirements in Ordinance No. 97-08 have been met to date, including a notice published on August 9, 2002, in the St. Pete Times, Pasco Edition, and notification by first-class mail to all property owners listed on the roll.
Viva Villas Paving Assessment project is located in Sections 14 & 23, Township 24 South, Range 16 East, on the west side of U.S.19, approximately one mile southwest of the intersection of U.S.19 and Little Road. All of the roads involved are currently paved, approximately thirty (30) years old, and County maintained. Right-of-way is by plat.
The Engineering Services Department proposes to level where necessary, resurface within existing length and width with Hot Mix Asphalt, and install necessary signs and markings. There are no drainage alterations included in this project.
A project cost estimate, based upon site inspection, proposed improvements, and the Annual Asphalt Contract, totals a maximum of $202,015.90, or $878.33 per benefited lot.
This is a single public hearing in accordance with Section VIII of Ordinance No. 97-08.
If the Board determines to make the improvements under Special Assessment Ordinance No. 97-08, a resolution must be adopted which includes the unit the assessments are to be based upon, the rate of interest, and the number of annual installments. The total maximum construction cost for this project exceeds Two Hundred Thousand dollars ($200,000.00). In accordance with the provisions of Section 255.20, Florida Statutes, the Board must competitively award this project to an appropriately licensed contractor unless the Board, after proper notice, finds that it is in public’s best interest to perform the project using the County’s own services, employees, and equipment together with the County’s Annual Asphalt Contract. The proposed resolution includes a specific determination by the Board that it is in the public’s best interest that a portion of the streets in the Viva Villas Paving Assessment project be performed by using the County’s own services, employees, and equipment in conjunction with the Annual Asphalt contract.
ALTERNATIVES AND ANALYSIS:
Based upon the information provided, some of the alternatives available to the Board in this matter are:
1. Accept the petition and authorize the Engineering Services Department to proceed with the paving of Viva Villas; approve the attached assessment roll; and adopt the attached resolution setting a maximum assessment of $878.33 per benefited lot for annual installments over a five-year period with 7.00 percent (7.00%) interest on the unpaid principal balance.
2. Authorize modification of the roll, assessment, or project as desired by the Board.
3. Discontinue the project.
RECOMMENDATION AND FUNDING:
The Engineering Services Department recommends that the Board approve Alternative No. 1, authorize the Chairman’s signature on the attached resolution, and direct Secretarial Services, Dade City, to distribute as follows: one copy of the executed resolution to Engineering Services Department, Design/Stormwater Management Division, New Port Richey; and one copy of the executed resolution to Development Services Administration, New Port Richey.
