This is in response to the petition of MIKE BENITEZ for: DONNA B. LEWIS; HARLAND A. GIDDINGS and GWEN P. GIDDINGS, his wife; SAMUEL S. TAWNEY and MARCELYN TAWNEY, his wife; and ROBERT G. HAGMAN, ROY R. HAGMAN, CAROL SHAW & HAGMAN PROPERTIES, INC., who have requested a public hearing before the Board of County Commissioner’s regular meeting of August 13, 2002.

 

It is recommended that the data herein presented be given formal consideration by the Board.

 

DESCRIPTION AND CONDITIONS:                                                                             

 

The petitioners seek to vacate the following right-of-way:

The petitioners request this vacation of right-of-way for the following reason:

 

The homeowners in the subdivision want to maintain their quiet, private, secluded street and their children want to be able to play without the parents having to worry about a major increase in the “cut through” traffic along the street.  They fear their street would become a cut-through to County Line Road.

 

The subject property is located on the southwest side of Sumpter Circle that intersects with Shadberry Lane.

 

Said portion of right-of-way has been dedicated to the public by the recorded plat of Country Close Subdivision, between Lot 10-Block 1 and Lot 12-Block 2, as recorded in Plat Book 20, Page 140, of the Public Records of Pasco County, Florida.

 

ALTERNATIVES AND ANALYSIS:

 

After reviewing the petition and inspecting the property, the Board has two alternatives:

 

1.        To approve the petition as requested.

 

2.        To disapprove the petition should there be some future need for this right-of-way.

 

RECOMMENDATION AND FUNDING:

 

Therefore, the Real Estate Division recommends the Board approve Alternative No. 1 and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described right-of-way of Lot 10-Block 1 and Lot 12-Block 2, Country Close Subdivision.

 

No funding will be required to complete this project.
