This is in response to the petition of Peter T. Di Croce and Gilda Di Croce, who have requested a public hearing before the Board of County Commissioner’s regular meeting of August 6, 2002.
It is recommended that the data herein presented be given formal consideration by the Board.
DESCRIPTION AND CONDITIONS:
The petitioners seek to vacate the following portion of easement:

BY REFERENCE MADE A PART THEREOF
The petitioners request this vacation of a portion of easement for the following reason:
Pool was constructed in November 1981, which encroaches into the easement at the rear of the property.
The subject property is located on the southwest side of Sumpter Circle that connects with Shadberry Lane.
Said portion of easement has been dedicated to the public by the recorded plat of Clayton Village, Phase I, Lot 407, as recorded in Plat Book 17, Pages 91 thru 94, of the Public Records of Pasco County, Florida.
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property, the Board has two alternatives:
1. To approve the petition as requested.
2. To disapprove the petition should there be some future need for this portion of easement.
RECOMMENDATION AND FUNDING:
Therefore, the Real Estate Division recommends the Board approve Alternative No. 1 and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described portion of easement of Lot 407, Clayton Village, Phase I.
No funding will be required to complete this project.
