This is in response to the petition of Steven O’Neill and Sandra L. O’Neill, who have requested a public hearing before the Board of County Commissioner’s regular meeting of August 6, 2002.
It is recommended that the data herein presented be given formal consideration by the Board.
DESCRIPTION AND CONDITIONS:
The petitioners seek to vacate the following portion of easement:

BY REFERENCE MADE A PART THEREOF
The petitioners request this vacation of a portion of easement for the following reason:
To vacate 1.45-foot encroachment of the screened pool enclosure, which extends into the 10-foot utility easement at the southeast corner of the property.
The subject property is located northeast of Magnum Court and east of Fieldspring Avenue.
Said portion of easement has been dedicated to the public by the recorded plat of River Crossing Unit Eleven, Lot 438, as recorded in Plat Book 26, Pages 65 thru 69, of the Public Records of Pasco County, Florida.
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property, the Board has two alternatives:
1. To approve the petition as requested.
2. To disapprove the petition should there be some future need for this portion of easement.
RECOMMENDATION AND FUNDING:
Therefore, the Real Estate Division recommends the Board approve Alternative No. 1 and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described portion of easement of Lot 438, River Crossing Unit Eleven.
No funding will be required to complete this project.
