This is in
response to the petition of John P. Naylor and D. J. Hiller, who have requested
a public hearing before the Board of County Commissioner’s regular meeting of
It is recommended that the data herein presented be given formal consideration by the Board.
DESCRIPTION AND CONDITIONS:
The petitioners seek to vacate the following portion of
easement:
COMMENCE AT THE
SOUTHWEST CORNER LOT 22, THE PRESERVE AT LAKE THOMAS PART 2 AS RECORDED IN PLAT
BOOK 35, PAGES 1-5 PASCO COUNTY, FLORIDA.
THENCE RUN N 23°32’58” E ALONG THE WEST LINE OF LOT 22, A DISTANCE OF
26.00 FEET TO THE POINT-OF-BEGINNING THENCE CONTINUE ALONG THE WEST LINE OF LOT
22, N 23°32’58” E. A DISTANCE OF 4.00 FEET TO THE NORTH LINE OF DRAINAGE
EASEMENT THENCE RUN ALONG SAID NORTH LINE OF SAID DRAINAGE EASEMENT S 67°52’11” E A DISTANCE OF 78.12 FEET TO THE
EAST LINE OF LOT 22, THENCE RUN N 70°47’47” W A DISTANCE OF 78.32 FEET, TO THE
POINT-OF-BEGINNING.
The petitioners request this vacation of a portion of easement for the following reason: To provide sufficient walk area (pool decking) along the south side of a 12-foot in-ground pool.
The subject property is located on the south side

easement has been dedicated to the public by Plat Book 35, Pages 1 through 5,
The Preserve at Lake Thomas Part 2,
The Pasco County Real Estate Division has not found any
objections to the petition to vacate the above-described portion of easement of
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property,
the Board has two alternatives:
1. To approve
the petition as requested.
2. To
disapprove the petition should there be some future need for this portion of
easement.
RECOMMENDATION AND FUNDING:
Therefore, the Real Estate Division recommends the Board
approve Alternative No. 1 and authorize the Chairman to execute the Notice of
Adoption of a Resolution, and the Resolution to vacate the above-described
portion of easement of
No funding will be required to complete this project.
