This is in response to the petition of John P. Naylor and D. J. Hiller, who have requested a public hearing before the Board of County Commissioner’s regular meeting of June 4, 2002.

 

It is recommended that the data herein presented be given formal consideration by the Board.

 

DESCRIPTION AND CONDITIONS:                                                                             

 

The petitioners seek to vacate the following portion of easement:

 

COMMENCE AT THE SOUTHWEST CORNER LOT 22, THE PRESERVE AT LAKE THOMAS PART 2 AS RECORDED IN PLAT BOOK 35, PAGES 1-5 PASCO COUNTY, FLORIDA.  THENCE RUN N 23°32’58” E ALONG THE WEST LINE OF LOT 22, A DISTANCE OF 26.00 FEET TO THE POINT-OF-BEGINNING THENCE CONTINUE ALONG THE WEST LINE OF LOT 22, N 23°32’58” E. A DISTANCE OF 4.00 FEET TO THE NORTH LINE OF DRAINAGE EASEMENT THENCE RUN ALONG SAID NORTH LINE OF SAID DRAINAGE EASEMENT  S 67°52’11” E A DISTANCE OF 78.12 FEET TO THE EAST LINE OF LOT 22, THENCE RUN N 70°47’47” W A DISTANCE OF 78.32 FEET, TO THE POINT-OF-BEGINNING.

 

The petitioners request this vacation of a portion of easement for the following reason: To provide sufficient walk area (pool decking) along the south side of a 12-foot in-ground pool.

 

The subject property is located on the south side of Marsh Hawk Drive, approximately 885 feet west of Preservation Drive.

 

Said easement has been dedicated to the public by Plat Book 35, Pages 1 through 5, The Preserve at Lake Thomas Part 2, Lot 22 as recorded in the Public Records of Pasco County, Florida.

 

The Pasco County Real Estate Division has not found any objections to the petition to vacate the above-described portion of easement of Lot 22, The Preserve at Lake Thomas Part 2.

 

ALTERNATIVES AND ANALYSIS:

 

After reviewing the petition and inspecting the property, the Board has two alternatives:

 

1.        To approve the petition as requested.

 

2.        To disapprove the petition should there be some future need for this portion of easement.

 

 

RECOMMENDATION AND FUNDING:

 

Therefore, the Real Estate Division recommends the Board approve Alternative No. 1 and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described portion of easement of Lot 22, The Preserve at Lake Thomas Part 2.

 

No funding will be required to complete this project.
