This is in
response to the petition of Richard H. Lyons and Barbara Ann Paulsen, who have
requested a public hearing before the Board of County Commissioner’s regular
meeting of
It is recommended that the data herein presented be given formal consideration by the Board.
DESCRIPTION AND CONDITIONS:
The petitioners seek to vacate the following portion of
easement:

REFERENCE MADE A PART THEREOF
The petitioners request this vacation of a portion of easement for the following reason: To clear title in order to close sale of property. Dwelling was built in easement in 1957 or 1958.
The subject property is located on the north side
of
Said
portion of easement has been dedicated to the public by Plat Book 10, Page 51,
Forest Hills Unit 20,
The Pasco County Real Estate Division has found two
objections to the petition to vacate the above-described portion of
easement. Pasco County Utilities and
Forest Hill Utilities, Inc. have requested License Grants from the petitioners. The petitioners have complied with these
requests and the executed License Grants accompany the petition.
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property,
the Board has two alternatives:
1. To approve
the petition as requested.
2. To
disapprove the petition should there be some future need for this easement.
RECOMMENDATION AND FUNDING:
Therefore, the Real Estate Division recommends the Board approve Alternative No. 1 and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the portion of easement, and the attached executed License Grants; and further instruct the Clerk of the Circuit Court to record the attached executed License Grants of Lot 1147, Forest Hills Unit 20.
No funding will be required to complete this project.
