This is in response to the petition of Betmar Acres Club, Inc., Lewis Hughes, Chairman of the Board, who has requested a public hearing before the Board of County Commissioner’s regular meeting of May 14, 2002.
It is recommended that the data herein presented be given formal consideration by the Board.
DESCRIPTION AND CONDITIONS:
The petitioner seeks to vacate the following right-of-way:
That portion of the 30’ platted right-of-way that adjoins the south line of Tract 64 and the north line of Tract 65 as shown on the plat of Zephyrhills Colony Company Lands in Section 09, Township 26 South, Range 21 East, and as recorded in Plat Book 1, Page 55, Public Records of Pasco County, Florida, said 30’ right-of-way being bounded on the east by the northerly right-of- way line of Lakewood Drive as shown on the plat of Lake Betmar Estates, 1st Addition, as recorded in Plat Book 11, Page 134 of the Public Records of Pasco County, Florida, and bounded on the west by the southerly right-of-way line of Strand Drive (Lake Drive by plat) as shown on the plat of Betmar Village Phase 1, as recorded in Plat Book 18, Page 82 of the Public Records of Pasco County, Florida;
and
That portion of the 30’ platted right-of-way that adjoins the south line of Tract 63 and the north line of Tract 66 as shown on the plat of Zephyrhills Colony Company Lands in Section 09, Township 26 South, Range 21 East and as recorded in Plat Book 1, Page 55, Public Records of Pasco County, Florida, said 30’ right-of-way being bounded on the east by the southerly right-of-way line of Strand Drive (Lake Drive by plat), and bounded on the west by the east line of Lot 592, both on the plat of Lake Betmar Estates, Units 3-5, as recorded in Plat Book 15, Page 107 of the Public Records of Pasco County, Florida.
The petitioner requests this vacation of right-of-way for the following reason: To construct a swimming pool.
The subject property is located south of Strand Drive and Apache Drive, and north of Lakewood Drive.
Said right-of-way has been dedicated to the public by the recorded plat in Plat Book 1, Page 55; Plat Book 11, Page 134; Plat Book 18, Page 82; Plat Book 15, Page 107; Zephyrhills Colony Company Lands, portion of Tracts 63, 64, 65, and 66 of the Public Records of Pasco County, Florida.
The Pasco County Real Estate Division has not found any objections to the petition to vacate the above-described right-of-way of Zephyrhills Colony Company Lands, portion of Tracts 63, 64, 65, and 66.
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property, the Board has two alternatives:
1. To approve the petition as requested.
2. To disapprove the petition should there be some future need for this vacation of right-of-way.
RECOMMENDATION AND FUNDING:
The Real Estate Division recommends the Board approve Alternative No. 1, and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described right-of-way of Zephyrhills Colony Company Lands, portion of Tracts 63, 64, 65, and 66.
No funding will be required to complete this project.
