This is in response to the petition of William L. Cardoza, who has requested a public hearing before the Board of County Commissioners regular meeting of April 23, 2002.
It is recommended that the data herein presented be given formal consideration by the Board.
DESCRIPTION AND CONDITIONS:
The petitioner seeks to vacate the following easement:
PORTION OF A 5.0 EASEMENT LYING ALONG THE NORTHERLY BOUNDARY OF LOT 2326, REGENCY PARK UNIT SIXTEEN, AS SHOWN ON PLAT RECORDED IN PLAT BOOK 17, PAGES 30, 31 AND 32 OF THE PUBLIC RECORDS OF PASCO COUNTY, FLORIDA, BEING MORE FULLY DESCRIBED AS FOLLOWS:
COMMENCE AT THE NORTHWEST CORNER OF SAID LOT 2326; THENCE SOUTH 23°0809 WEST, 5.01 FEET ALONG THE NORTHWESTERLY BOUNDARY LINE OF SAID LOT 2326; THENCE SOUTH 63°2712 EAST, 10.24 FEET TO THE POINT OF BEGINNING; THENCE NORTH 26°3248 EAST, 1.01 FEET; THENCE SOUTH 61°2949 EAST, 23.86 FEET; THENCE SOUTH 26°32 48 WEST, 0.20 FEET TO A POINT ON THE SOUTHERLY BOUNDARY OF SAID 5.0 FOOT EASEMENT; THENCE NORTH 63°2712 WEST, 23.85 FEET ALONG THE SOUTHERLY BOUNDARY OF SAID 5.0 FOOT EASEMENT TO THE POINT OF BEGINNING.
The petitioner requests this vacation of easement for the following reason: The concrete slab of the swimming pool enclosure encroaches into the 5 easement on the north boundary of said property.
The subject property is located approximately 445 feet northwest of Treasure Pointe Drive on the north side of Lakeside Drive.
Said easement has been dedicated to the public by Plat Book 17, Pages 30, 31, and 32, Regency Park Unit Sixteen, Lot 2326, as recorded in the Public Records of Pasco County, Florida.
The Pasco County Real Estate Division has not found any objections to the petition to vacate the above-described easement of Lot 2326, Regency Park Unit Sixteen.
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property, the Board has two alternatives:
1. To approve the petition as requested.
2. To disapprove the petition should there be some future need for this easement.
RECOMMENDATION AND FUNDING:
Therefore, the Real Estate Division recommends the Board approve Alternative No. 1, and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described easement of Lot 2326, Regency Park Unit Sixteen.
No funding will be required to complete this project.
