This is in response to the petition
of Edmund Sampson, Jr., Joan S. Sampson, and R.P.M. & Associates, Inc.,
Danny O’Meara, President, who have requested a public hearing before the Board
of County Commissioner’s regular meeting of
It is recommended that the data
herein presented be given formal consideration by the Board.
DESCRIPTION AND CONDITIONS:
The petitioners seek to vacate
the following right-of-way:
A PORTION
OF LAND BEING A PORTION OF, PINE ACRES SUBDIVISION, ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK 5, PAGE 156,
COMMENCE
AT THE NORTHEAST CORNER OF LOT 12 OF THE AFORMENTIONED PINE ACRES SUBDIVISION,
THENCE RUN NORTH 89°43’05” WEST, 38.56 FEET TO THE POINT OF BEGINNING, THENCE
NORTH 00°16’55” EAST, 30.00 FEET TO A POINT OF CURVATURE THENCE 42.27 FEET
ALONG THE ARC OF A CURVE TO THE RIGHT HAVING A RADIUS OF 30.00 FEET, A CENTRAL
ANGLE OF 80°44’20”. A CHORD BEARING AND
DISTANCE OF SOUTH 23°10’32” WEST, 64.71 FEET TO THE POINT OF BEGINNING.
The petitioner requests this
vacation of right-of-way for the following reason:
Home encroaches into the
right-of-way of a non-county maintained road, which has been used as a gated
driveway to the home. This vacation is needed
in order for the petitioners to refinance mortgage.
The subject property is located
in the northwest cul-de-sac area of
Said right-of-way has been dedicated
to the public by the recorded plat in Plat Book 5, Page 156, Pine Acres Subdivision,
The Pasco County Real Estate
Division has not found any objections to the petition to vacate the
above-described right-of-way of Pine Acres Subdivision,
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and
inspecting the property, the Board has two alternatives:
1. To approve the petition as requested.
2. To disapprove the petition should there
be some future need for this vacation of right-of-way.
RECOMMENDATION AND FUNDING:
Therefore, the Real Estate
Division recommends the Board approve Alternative No. 1, and authorize the
Chairman to execute the Notice of Adoption of a Resolution, and the Resolution
to vacate the above-described right-of-way of Pine Acres Subdivision,
No funding will be required to
complete this project.
