This is in response to the petition of Joan A. Rees, who has requested a public hearing before the Board of County Commissioner’s regular meeting of April 23, 2002.

 

It is recommended that the data herein presented be given formal consideration by the Board.

 

DESCRIPTION AND CONDITIONS:                                                                                        

 

The petitioner seeks to vacate the following right-of-way:

 

A PORTION OF TRACTS 2 AND 15 OF “PORT RICHEY LAND COMPANY SUBDIVISION”, OF SECTION 4, TOWNSHIP 26 SOUTH, RANGE 16 EAST, PASCO COUNTY, FLORIDA, AS RECORDED IN PLAT BOOK 1, PAGES 60-61 OF THE PUBLIC RECORDS OF FLORIDA.  BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

 

THE SOUTH 15.00 FEET OF TRACT 2 OF “PORT RICHEY LAND COMPANY SUBDIVISION”, OF SECTION 4, TOWNSHIP 26 SOUTH, RANGE 16 EAST, PASCO COUNTY, FLORIDA, AS RECORDED IN PLAT BOOK 1, PAGES 60-61 OF THE PUBLIC RECORDS OF PASCO COUNTY, FLORIDA AND THE NORTH 15.00 FEET OF TRACT 15 OF “PORT RICHEY LAND COMPANY SUBDIVISION”, OF SECTION 4, TOWNSHIP 26 SOUTH, RANGE 16 EAST, PASCO COUNTY, FLORIDA, AS RECORDED IN PLAT BOOK 1, PAGES 60-61 OF THE PUBLIC RECORDS OF PASCO COUNTY, FLORIDA.

 

The petitioner requests this vacation of right-of-way for the following reason:

 

Property under contract for Sale and Purchase with Hospice Holdings, Inc.  Vacation necessary for construction of a residential treatment and care facility for Hospice.

 

The subject property is located south of Massachusetts Avenue and west of Rowan Road.

 

Said right-of-way has been dedicated to the public by the recorded plat in Plat Book 1, Pages 60 and 61, Port Richey Land Company Subdivision, Tracts 2 and 15, of the Public Records of Pasco County, Florida.

 

The Pasco County Real Estate Division has not found any objections to the petition to vacate a portion of Tracts 2 and 15, Port Richey Land Company Subdivision.

 

ALTERNATIVES AND ANALYSIS:

 

After reviewing the petition and inspecting the property, the Board has two alternatives:

 

1.     To approve the petition as requested.

 

2.      To disapprove the petition should there be some future need for this vacation of right-of-way.

 

 

RECOMMENDATION AND FUNDING:

 

Therefore, the Real Estate Division recommends the Board approve Alternative No. 1, and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described right-of-way of Port Richey Land Company Subdivision, portion of Tracts 2 and 15.

 

No funding will be required to complete this project.
