This is in response to the petition of Elizabeth A. Minnick, who has requested a public hearing before the Board of County Commissioner’s regular meeting of April 23, 2002.
It is recommended that the data herein presented be given formal consideration by the Board.
DESCRIPTION AND CONDITIONS:
The petitioner seeks to vacate the following easement:
PORTION OF THE 10.0 FOOT EASEMENT LOCATED ALONG THE SOUTHERLY BOUNDARY OF LOT 835, COLONIAL HILLS UNIT ELEVEN, AS SHOWN ON PLAT RECORDED IN PLAT BOOK 10, PAGES 91 AND 92 OF THE PUBLIC RECORDS OF PASCO COUNTY, FLORIDA, BEING MORE FULLY DESCRIBED AS FOLLOWS: COMMENCE AT THE SOUTHEAST CORNER OF SAID LOT 835; THENCE NORTH 00°03’59” EAST, ALONG THE EASTERLY BOUNDARY OF SAID LOT 835, 10.0 FEET; THENCE NORTH 89°50’29” WEST, 4.80 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 00°03’59” WEST, 4.60 FEET; THENCE NORTH 89°31’46” WEST, 55.20 FEET TO A POINT ON THE WESTERLY BOUNDARY OF SAID LOT 835; THENCE NORTH 00°03’59” EAST, ALONG SAID WESTERLY BOUNDARY, 4.30 FEET; THENCE SOUTH 89°50’29” EAST, 55.20 FEET TO THE POINT OF BEGINNING.
The petitioner requests this vacation of easement for the following reason: Swimming pool and enclosure are encroaching on the ten-foot easement located along the southerly boundary.
The subject property is located on the south side of Sparrow Drive, approximately 325 feet west of Bluebird Drive (and approximately 190 feet east of Meadowlark Drive).
Said easement has been dedicated to the public by Plat Book 10, Pages 91 and 92, Colonial Hills Unit 11, Lot 835 as recorded in the Public Records of Pasco County, Florida.
The Pasco County Real Estate Division has not found any objections to the petition to vacate the above-described easement of Lot 835, Colonial Hills Unit 11.
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property, the Board has two alternatives:
1. To approve the petition as requested.
2. To disapprove the petition should there be some future need for this easement.
RECOMMENDATION AND FUNDING:
Therefore, the Real Estate Division recommends the Board approve Alternative No. 1, and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described easement of Lot 835, Colonial Hills Unit 11.
No funding will be required to complete this project.
