PASCO COUNTY, FLORIDA
INTER-OFFICE MEMORANDUM

This is in response to the petition
of Gary L. Blackwell, as Trustee of the Gary L. Blackwell Trust dated April 8, 1991,
and
Riverside Baptist Fellowship, Inc., who have requested a public hearing before
the Board of County Commissioner’s
regular meeting of April 2, 2002.
It is recommended that the data herein presented be given formal consideration by the Board.
The petitioners
request this vacation of roadway(s) and right-of-way as they have noted for the
following reason:
The property is being developed as a residential
subdivision and roads for ingress and egress will be adequately
provided to
serve the lots in the subdivision as well as the adjoining property owners who
have previously
traversed a portion of this property for their access.
All adjoining properties will be given necessary easements for
both ingress and egress, and
utilities as needed.
The subject properties are located south of Perrine Ranch Road and west of Olde Farm Road.
DESCRIPTION AND CONDITIONS:
The petitioners seek to vacate the following:

AND BY REFERENCE MADE A PART THEREOF
Said roadway(s) have been open to the public and maintained by Pasco County for a period in excess of 30 years.
Said right-of-way
has been dedicated to the public by the recorded plat of Tampa-Tarpon Springs
Land Company
as recorded in Plat Book 1, Pages 69 thru 70A
in the Public Records of Pasco County,
Florida.
The Pasco
County Real Estate Division has found objections to the petition to vacate the
right-of-way and roadway(s)
described
in attached Exhibits “A”, “B”, and “C”. The objections are noted as follows:
FLORIDA POWER:
(Objects) - Has facilities within the area that would need to be located and
field checked. Consent
to vacate would be contingent upon the dedication of
utility easements to accommodate existing electrical facilities.
Facilities that require relocation would be done at no
cost to Florida Power Corporation.
VERIZON: (Comments) - Has no objection providing proposed vacation will become a utility easement.
PASCO COUNTY:
ENGINEERING SERVICE DEPARTMENT: (Objects) - Unless acceptable access is provided to affected property owners.
ASSISTANT ENGINEERING SERVICES DIRECTOR: (Comments) - We need to make sure access is in place prior to vacation.
PUBLIC WORKS: (Objects) - Unless an acceptable
alternative access is provided to the property owners presently using Outrider
Road for access to their property.
DEVELOPMENT REVIEW SERVICES: (Comments) - The proposed
subdivision plans for this area have not been submitted for
review or
approval. Therefore, any vacation prior to platting would cut off access
to residential properties at end of road.
This should be denied unless effected
parties are provided legal access and agreed to this vacation.
GROWTH MANAGEMENT: (Comments) - Outrider Road provides the sole access from Perrine Ranch Road to Stockman Road.
Accordingly, staff recommends
denial of the proposed vacation of Outrider Road in that access to Perrine Ranch Road will be
denied to property owners to the west of the
subject parcel. Staff recommends that the applicant provide an alternative
access
to Stockman
Road from Perrine Ranch Road that is acceptable to abutting
property owners.
PROJECT MANAGEMENT: (Comments) - The graphics and exhibits are so poorly coordinated that it is difficult to visualize the impact of this request.
STORMWATER: (Comments) - All adjoining properties shall be
given necessary easements for both ingress and egress and utilities as
needed as stated in the request prior to the Vacation of Roadway and
Right-of-Way.
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property, the Board has two alternatives:
1. To recommend denial unless an alternative, acceptable access is provided to the residents, and all above objections are removed.
2. To approve the petition as requested.
RECOMMENDATION AND FUNDING:
The Real
Estate Division recommends the Board approve alternative No. 1, therefore
denying this vacation unless an alternative, acceptable,
access is provided
to the affected residents, and all objections stated above are removed.
Upon approval, the Board will authorize the Chairman
to execute the Notice of Adoption of a Resolution, and the Resolution to vacate
the describe vacation of roadway(s) and right-or-way in Exhibits “A”, “B”, and
“C”.
No funding will be required to complete this project.
