This is in response to the petition of Danny N. Felts and Glenda F. Felts, who have requested a public hearing before the Board of County Commissioner’s regular meeting of March 26, 2002.

It is recommended that the data herein presented be given formal consideration by the Board.

DESCRIPTION AND CONDITIONS:

The petitioners seek to vacate the following portion of easement:

COMMENCE AT THE SOUTHWEST CORNER OF LOT #637, JASMINE LAKES UNIT 5-D AS RECORDED IN PLAT BOOK 10, PAGE 11 OF THE PUBLIC RECORDS OF PASCO COUNTY, FLORIDA; THENCE NORTH 0°21’11" EAST A DISTANCE OF 24.50 FEET; THENCE SOUTH 89°54’36" EAST A DISTANCE OF 3.20 FEET; TO THE POINT OF BEGINNING; THENCE NORTH 0°21’11’ EAST A DISTANCE OF 39.00 FEET, THENCE SOUTH 89°54’36" EAST A DISTANCE OF 6.80 FEET; THENCE SOUTH 0°21’11" WEST A DISTANCE OF 39.00 FEET; THENCE NORTH 89°54’36" WEST A DISTANCE OF 6.80 FEET; TO THE POINT OF BEGINNING.

The petitioners request this vacation of a portion of easement for the following reason: To clear title for sale of property, because screen enclosure and swimming pool encroached easement.

The subject property is located on the corner of the south side of Canna Drive (Field) - Lantana Drive (Plat), and Laburnum Drive (Field) - East Oak Hill Drive (Plat).

Said portion of easement has been dedicated to the public by Plat Book 10, Page 11, Jasmine Lakes Unit 5-D, Lot 637, as recorded in the Public Records of Pasco County, Florida.

The Pasco County Real Estate Division has not found any objections to the petition to vacate the above-described portion of easement of Lot 637, Jasmine Lakes Unit 5-D.

ALTERNATIVES AND ANALYSIS:

After reviewing the petition and inspecting the property, the Board has two alternatives:

1. To approve the petition as requested.

2. To disapprove the petition should there be some future need for this portion of easement

RECOMMENDATION AND FUNDING:

Therefore, the Real Estate Division recommends the Board approve Alternative No. 1, and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described portion of easement of Lot 637, Jasmine Lakes Unit 5-D.

No funding will be required to complete this project.
