AN ORDINANCE TO BE ENTITLED

AN ACT BY THE BOARD OF COUNTY COMMISSIONERS OF PASCO COUNTY, FLORIDA, AMENDING ORDINANCE NOS. 79-28 and 01-012, AS SUBSEQUENTLY AMENDED, WHICH CREATED THE PASCO COUNTY MUNICIPAL FIRE SERVICE UNIT, BY ADDING TO THE UNIT ALL OF THE LAND O' LAKES FIRE DEPARTMENT AREA DESCRIBED GENERALLY AS ALL OR PORTION OF SECTIONS 22, 26-27, AND 33-36, TOWNSHIP 25 SOUTH, RANGE 18 EAST, PASCO COUNTY, FLORIDA; ALL OR PORTION OF SECTIONS 17, 20-21, AND 29-32, TOWNSHIP 25 SOUTH, RANGE 19 EAST, PASCO COUNTY, FLORIDA; ALL OR PORTIONS OF SECTIONS 1-3, 10-15, 23-26, AND 35-36, TOWNSHIP 26 SOUTH, RANGE 18 EAST, PASCO COUNTY, FLORIDA; ALL OR PORTIONS OF SECTIONS 4-9, 16-20, AND 29-32, TOWNSHIP 26 SOUTH, RANGE 19 EAST, PASCO COUNTY, FLORIDA; AND AS MORE PARTICULARLY DESCRIBED AND SET FORTH IN EXHIBITS "A" AND "B" OF THIS ORDINANCE; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN CODE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR MODIFICATION THAT MAY ARISE FROM CONSIDERATION OF THE ORDINANCE AT PUBLIC HEARING.

NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pasco County, Florida, as follows:

Section 1.

Ordinance Nos. 79-28 and 01-012, as subsequently amended, is hereby amended as follows:

1. All of LAND O' LAKES VOLUNTEER FIRE DEPARTMENT, as set forth and described in Exhibits "A" and "B," which are attached hereto and incorporated herein by reference, is hereby made a part of and subject the Pasco County Municipal Fire Service Unit.

Section 2. Repealer.

Any ordinance in conflict herewith is hereby repealed to the extent of any conflict.

Section 3. Severability.

It is declared to be the intent of the Board of County Commissioners that if any section, subsection, sentence, clause, or provision of this ordinance shall be declared invalid, the remainder of this ordinance shall be construed as not having contained such section, subsection, sentence, clause, or provision and shall not be affected by such holding.

Section 4. Inclusion in Code.

It is the intent of the Board of County Commissioners that the provisions of this ordinance shall become and be made a part of the Pasco County Code of Ordinances, and "ordinance" may be changed to "section," "article," "regulation," or other appropriate word or phrase in order to accomplish such intentions.

Section 5. Effective Date.

A certified copy of this ordinance shall be filed with the Department of State by the Clerk to the Board of County Commissioners within ten (10) days after adoption of this ordinance and shall take effect upon official acknowledgment from that office that the said ordinance has been filed.
