It is recommended that the data herein presented be given formal consideration by the Board of County Commissioners.
DESCRIPTION AND CONDITIONS:
On December 4, 2001, the Board directed the developer of Meadow Oaks MPUD Master Planned Unit Development to construct the unimproved portion of Fairwinds Road to be passable to construction and heavy vehicle traffic within 90 days and thus comply with the following condition of the MPUD Master Planned Unit Development, which states:
"31. Construction traffic and heavy vehicles shall be restricted to entering the MPUD Master Planned Unit Development site via Fairwinds Road and Harper/Hamilton Road (now known as Hudson Avenue)."
Improvements to Fairwinds Road have not occurred and construction traffic continues to enter the development from S.R. 52 through Sugar Creek Subdivision.
In accordance with the Board's directive, the Growth Management Department has brought this item back before the Board to determine if there are violations to the MPUD Conditions of Approval and decide upon appropriate action to be taken to enforce the MPUD conditions.
The Growth Management Department staff is requesting that the Board authorize the suspension of all construction within the Meadow Oaks MPUD until that portion of Fairwinds Road within the Meadow Oaks MPUD is improved to allow Meadow Oaks construction and heavy vehicle traffic access to the development. The developer is still required to make further improvements to Fairwinds Road prior to Board approval of any record plat or site plan involving units or development beyond the 550th residential unit.
ALTERNATIVES AND ANALYSIS:
RECOMMENDATION AND FUNDING:
The Growth Management Department staff recommends that the Board approve Alternative No. 1.
No funding is required.
