DESCRIPTION AND CONDITIONS:
On October 30, 2000, the Wesley Chapel Lakes Development of Regional Impact (DRI) Notice of Proposed Change (NOPC) was submitted to the Florida Department of Community Affairs, Tampa Bay Regional Planning Council, and Pasco County. NOPC will amend the existing DRI as follows: add land; revise Map H; extend the build-out date for each phase and the expiration date of DO by a cumulative 15 years; revise the distribution of entitlements among phases and obtain specific approval for all residential entitlements; revise the proportionate share; revise the traffic mitigation provisions; revise the pipeline improvements and the schedule for its construction; and reduce the number of units allocated for elderly housing.
Pursuant to Subsection 380.06(19), the local government shall establish a public hearing to consider the change that the developer asserts does not create a substantial deviation. The public hearing was originally scheduled for October 18, 2001, and was subsequently continued to October 16, 2001, November 14, 2001, December 11, 2001, and February 11, 2002. The continuances were necessary to allow time for staff and the applicant to resolve issues related to NOPC.
Presently, staff is recommending that the Board withdraw the Wesley Chapel Lakes DRI NOPC from the Board's agenda. It is the opinion of staff that the number of continuances has compromised the intent and purpose of the public notice for the public hearing. Accordingly, rather than recommend an arbitrary continuance of the project to a future public hearing, staff will re-agenda the project and provide the required public notice once the project has progressed through the review process, including DRC. Alternatively, the Board may consider continuing the public hearing to a future date, such as March 19, 2002, at 9:30 a.m., in Dade City.

The Growth Management Department staff recommends that the Board approve Alternative No. 1.
