This is in response to the petition of Joseph John Edwin Isolani, Jr. and Mary Jewell Isolani, who have requested a public hearing before the Board of County Commissioner’s regular meeting of January 8, 2002.
It is recommended that the data herein presented be given formal consideration by the Board.
The petitioners request this vacation for a portion of easement for the following reason: Swimming pool encroaches into drainage easement.
The subject property is located approximately 750 feet north of Grandview Avenue.
DESCRIPTION AND CONDITIONS:
The petitioners seek to vacate the following portion of easement:
A PORTION OF PLATTED DRAINAGE EASEMENT ALONG THE REAR OF LOT 9, OYSTER BAYOU, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 26, PAGES 43-45, OF THE PUBLIC RECORDS OF PASCO COUNTY, FLORIDA, BEING FURTHER DESCRIBED AS FOLLOWS:
FOR A POINT OF COMMENCEMENT, BEGIN AT THE SOUTHEAST CORNER OF SAID LOT 9: THENCE GO NORTH 24°39’14" EAST ALONG THE EASTERLY BOUNDARY LINE OF SAID LOT 9, A DISTANCE OF 100.00 FEET TO SAID PLATTED EASEMENT: THENCE GO NORTH 81°19’21" WEST, ALONG SAID PLATTED EASEMENT A DISTANCE OF 8.78 FEET FOR A POINT OF BEGINNING; THENCE GO NORTH 19°19’16" EAST A DISTANCE OF 0.91 FEET; THENCE GO NORTH 70°40’44" WEST, A DISTANCE OF 30.76 FEET; THENCE GO SOUTH 19°19’16" WEST, A DISTANCE OF 6.69 FEET, TO SAID PLATTED EASEMENT LINE; THENCE GO SOUTH 81°19’21" EAST, ALONG SAID PLATTED EASEMENT LINE A DISTANCE OF 31.30 FEET TO THE POINT OF BEGINNING, SAID AREA OF PROPOSED VACATION CONTAINING 117 SQUARE FEET MORE OR LESS.
Said portion of easement has been dedicated to the public by Plat Book 26, Pages 43–45, Oyster Bayou, Lot 9, as recorded in the Public Records of Pasco County, Florida.
The City of New Port Richey held a public hearing on November 6th, 2001 in the Council Chambers, City Hall, 5919 Main Street, New Port Richey, whereby Resolution 01-13 was adopted. A copy of this adopted Resolution is attached.
The Pasco County Real Estate Division has not found any objections to the petition to vacate a portion of the above-described easement of Lot 9, Oyster Bayou.
ALTERNATIVES AND ANALYSIS:
After reviewing the petition and inspecting the property, the Board has two alternatives:
1. To approve the petition as requested.
2. To disapprove the petition should there be some future need for this portion of easement.
RECOMMENDATION AND FUNDING:
Therefore, the Real Estate Division recommends the Board approve Alternative No. 1, and authorize the Chairman to execute the Notice of Adoption of a Resolution, and the Resolution to vacate the above-described portion of easement of Lot 9, Oyster Bayou.
No funding will be required to complete this project.
